These Website Terms & Conditions (“Terms”) govern your access to and use of https://www.jdwebcraft.com and any subdomains (collectively, the “Site”), operated by JD Webcraft Web Development Services (“JD Webcraft,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

You may use the Site only for lawful purposes and in a way that does not infringe others’ rights or interfere with the Site’s operation.
5) Prohibited use
You agree not to:
- misuse the Site for unlawful, harmful, abusive, defamatory, or fraudulent activity
- attempt unauthorized access to the Site, servers, or systems
- disrupt or attack the Site (malware, scraping, DDoS, probing, etc.)
- copy, reproduce, or republish our Site content without written permission
- spam our forms, inboxes, or communication channels
6) Intellectual property
All Site content (text, branding, layout, visuals, code, downloadable materials, and other content) is owned by or licensed to JD Webcraft and protected by intellectual property laws.
You may view the Site for personal/business reference only. You may not reproduce or distribute any content without written permission.
7) Submissions through forms (including uploads)
The Site may allow you to submit information through forms (including uploads) hosted either on our Site or through third-party form platforms (e.g., Jotform).
You agree that anything you submit:
- is accurate to the best of your knowledge,
- does not violate any law or third-party rights,
- does not include harmful code or malware, and
- you have the right to share it with us.
Confidentiality note: Please do not submit sensitive information (e.g., passwords, financial account credentials). If sensitive data is necessary for a project, we will request it through a secure method.
Feedback: If you send suggestions/feedback about our services or Site, you allow us to use it without obligation or compensation.
8) Third-party forms, links, and tools
Some Site features may be provided by third parties (form tools, payment platforms, scheduling tools, embeds, etc.). Their terms and privacy policies may apply in addition to ours, and we are not responsible for third-party platforms or services. (Jotform)
9) Portfolio, case studies, and showcased work
We may display selected work samples, portfolio items, or case studies for marketing purposes. Third-party trademarks and logos remain the property of their owners.
Opt-out requests: If you are a client and want a portfolio/case study item removed or adjusted, contact legal@jdwebcraft.com. We will consider reasonable requests.
10) Price guides, quote builder, and proposals
Any starting prices, guide prices, or estimate tools on the Site are informational only and not a binding offer.
A binding offer exists only when we provide a written proposal/statement of work and you accept it in writing (or via agreed acceptance method).
Quote/proposal validity: Unless stated otherwise, proposals/quotes expire 90 days after issuance.
11) Consultations
We may offer free consultations. A consultation does not create a client relationship by itself. A client relationship begins only when both parties agree in writing to start work under agreed terms.
12) Payments (if applicable)
If you purchase services, payments may be processed via invoicing and/or third-party payment methods such as Wise, PayPal, Payoneer, GCash, Maya, or local bank transfer.
Any payment terms for services (including milestones, deposits/retainers, scope, and deliverables) are governed primarily by your Service Agreement / Proposal / Invoice Terms. If there is any conflict between those documents and these Website Terms, the Service Agreement/Proposal/Invoice Terms control.
13) Deposits/retainers
If a project requires an upfront deposit or retainer, it is typically used to reserve capacity and cover initial administrative/planning work. Unless we explicitly state otherwise in writing, such payments are non-refundable to the extent allowed by law.
Why this matters legally: in many jurisdictions, “non-refundable” amounts are most defensible when they reflect a reasonable estimate of losses/costs and aren’t an unfair penalty. (LegalClarity)
14) No guarantee of results
We aim to deliver high-quality work using proven web, UX, and SEO best practices. However, you understand that outcomes such as search rankings, traffic, conversion rates, revenue, and marketing performance depend on many factors outside our control (competition, market conditions, your content, ongoing marketing efforts, algorithm updates, and more). Therefore, we do not guarantee specific results.
15) Disclaimers
The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose, merchantability, and non-infringement.
We do not guarantee the Site will be uninterrupted, error-free, secure, or free from viruses.
16) Limitation of liability
To the maximum extent permitted by law, JD Webcraft will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site.
If we are found liable for any claim related to the Site, our total liability will be limited to the amount you paid us (if any) for use of the Site in the 12 months before the event giving rise to the claim.
17) Indemnity
You agree to defend, indemnify, and hold harmless JD Webcraft from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Site, your submissions, or your violation of these Terms.
18) Termination
We may suspend or terminate access to the Site at any time if we believe you violated these Terms or used the Site unlawfully.

20) International users
We operate globally and do not represent that the Site is appropriate or available in every location. If you access the Site from outside the Philippines, you do so on your own initiative and are responsible for compliance with local laws.
21) Dispute resolution, governing law, and venue
Governing law: Philippines.
Clause:
- The parties will first attempt to resolve disputes informally through good-faith discussions.
- If unresolved, the parties agree to attempt mediation in good faith before filing court action (unless urgent injunctive relief is needed).
- If still unresolved, disputes will be filed in the courts of competent jurisdiction in the Philippines (venue: Davao City, unless mandatory consumer protection laws require otherwise).
22) Miscellaneous
- Severability: If any part of these Terms is unenforceable, the rest remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Entire agreement (Site use): These Terms govern Site use only, while client work is governed by your Service Agreement/Proposal/Invoice Terms.
